These Terms of Service ("Terms") are an agreement between you and Cajun Solutions LLC, a Missouri limited liability company ("Noshera", "we", "us"), for your use of the Noshera app and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Noshera is a consumer nutrition and health diary. It lets you log food, track calories, macros, weight, water, and activity, and build custom foods, recipes, and meals. We offer a free tier and may offer paid tiers in the future. We may add, change, or remove features over time.
2. Not medical advice
Noshera is a wellness and informational tool, not a medical device or a healthcare provider. It does not provide medical advice, diagnosis, or treatment, and its calculations and estimates may be imperfect. Always consult a qualified healthcare professional before making decisions about your diet, exercise, health, or any medical condition. You use the Service at your own discretion and risk.
3. Eligibility
You must be at least 13 years old to use Noshera. By using the Service, you represent that you meet this requirement and that the information you give us is accurate.
4. Your account
You are responsible for your account and for keeping your login credentials secure. You are responsible for activity that happens under your account. Tell us promptly at [email protected] if you suspect unauthorized use. Keep any personal API tokens you generate confidential; treat them like passwords.
5. Acceptable use
You agree not to:
- Break the law or infringe anyone's rights while using the Service.
- Access, tamper with, or disrupt the Service, its infrastructure, or other users' data.
- Attempt to bypass security, rate limits, or authentication.
- Use the Service, its API, or its food database as a bulk data source for a competing product, or scrape it.
- Upload malware, or content that is unlawful, abusive, or infringing.
- Resell or commercially exploit the Service except as we expressly allow.
6. Your content stays yours
The data and content you create in Noshera — your food logs, custom foods, recipes, custom meals, notes, and photos ("Your Content") — belong to you. We do not claim ownership of Your Content. You grant us only the limited license needed to host, store, back up, and display Your Content back to you (and, where you explicitly enable public sharing, to the people you share it with) so we can operate the Service. You are responsible for Your Content and confirm you have the rights to it.
7. Public sharing
If you choose to enable a public journal feed, you understand that the data you opt to include becomes viewable by anyone with the link. You can disable or revoke a share link at any time. Sharing is entirely optional and off by default.
8. Fees and future paid plans
The Service is currently offered free of charge. If we introduce paid plans, we will present the price and terms before you buy, and any purchase will be subject to those additional terms. Purchases made through the Apple App Store are also governed by Apple's terms and handled through your Apple account.
9. Third-party services
Noshera relies on third-party infrastructure (including Supabase and Cloudflare) and, on iOS, integrates with Apple Health when you permit it. Your use of those integrations may also be governed by the relevant provider's terms. We are not responsible for third-party services we do not control.
10. The Service is provided "as is"
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that nutrition data and calculations will be accurate or complete. You are responsible for maintaining your own copies of important data.
11. Limitation of liability
To the fullest extent permitted by law, Cajun Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $50.
12. Termination
You may stop using Noshera and delete your account at any time (see the Support page). We may suspend or terminate your access if you violate these Terms or use the Service in a way that harms other users or the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (such as content ownership, disclaimers, and liability limits) will survive.
13. Changes to these Terms
We may update these Terms as the Service evolves. When we make material changes, we will update the effective date above and, where appropriate, notify you in the app or by email. Continued use after an update means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Missouri will have jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there. Nothing here prevents either of us from seeking to resolve a dispute informally first — and we would prefer that; just email us.
